In her line of questioning, California Sen. Kamala Harris tried to draw out a situation in which attorney general nominee William Barr would not take the advice of career ethics officials if they advised him to recuse himself.
If it came down to a judgement call, Barr said he could ignore the advice of those officials — if he disagreed with that advice based on a “different judgement of the facts.”
Here’s how the exchange went down:
Harris: So my question is would it be appropriate to go against the advice of career ethics officials that have recommended recusal, and can you give an example of under what situation or scenario you would go against the recommendation that you recuse yourself?
Barr: Well there are different kinds of recusals. Some are mandated for example if you have a financial interest, but there are others that are judgment calls-
Harris: Let’s imagine it’s a judgment call, and the judgment by the career ethics officials in the agency are that you recuse yourself. Under what scenario would you not follow their recommendation.
Barr: If I disagreed with it.
Harris: And what would the basis of that disagreement be?
Barr: I came to a different judgement.
Harris: On what basis?
Barr: The facts.
Harris: Such as-
Barr: Such as whatever facts are relevant to the recusal.
Harris: What do you imagine that the facts would be that are relevant to the recusal?
Barr: They could innumerable. I mean, there a lot of, you know know for example, there’s a rule of necessity, like who else would be handling it-
Harris: Do you believe that would be a concern in this situation if you are- if the recommendation is that you recuse yourself from the Mueller investigation do you believe that would be a concern that there would be no one left to do the job?
Barr: No, I’m just saying well, in some context, there very well might be, because who is confirmed for what and who is in what position. But a part from that, it’s a judgment call, and the attorney general is the person who makes the judgement and that’s what the job entails.
Harris: As a general matter that’s true, but specifically in this issue, under what scenario would you imagine that you would not follow the recommendation of the career ethics officials in the Department of Justice to recuse yourself from the Mueller investigation.

Merkel has been a symbol of stability in Europe since she took on the role of chancellor in 2005. But after almost 16 years in the top job, she will step down once it becomes clear who her successor will be.
The SPD and CDU, the two largest parties in German politics, have been sharing power under Merkel’s fourth term as chancellor.
CDU leader Armin Laschet, the party’s candidate to be the next chancellor and premier of North Rhine-Westphalia, held a final campaign rally with Merkel in Aachen on Saturday.
A boy presented Merkel, 67, with a gingerbread heart iced with the words “Thanks CDU,” and another supporter gave her a cake decorated with a picture of her trademark rhombus hand gesture.
Rival candidate Olaf Scholz, from the Social Democrats, is holding his last rally Saturday in his constituency in Potsdam. Scholz has been serving as the vice-chancellor and German finance minister since 2018.

According to the latest polls, the Social Democrats are polling at 25.2% and could gain 4.7 percentage points compared to the 2017 national elections. This lead could mean a reversal of a 20-year-long downward trend for the Social Democrats. Over the past two decades, the party has lost around half of its voters.
The Christian Democrats are trailing several percentage points behind the SPD at around 22.4%, polls indicate. This could mean a loss of 10.5 percentage points compared to the 2017 national elections, and of 19.1 percentage points compared to the 2013 elections.
The Greens are currently polling at 15.9%, in third place. However, the ecological party could record the strongest growth of all parties in the next federal election, with a potential gain of 7.5 percentage points compared to the last national elections in 2017. The Greens’ leader, Annalena Baerbock, has emerged as a contender for chancellor and potential kingmaker in the coalition negotiations expected to follow Sunday’s vote.
Germany’s business-friendly Free Democratic Party (FDP) is polling at 11.1% and is slated to make only marginal gains compared to the last national elections, according to poll predictions.
The far-right Alternative for Germany party (AfD) is polling at 10.6% — a decrease of 2 percentage points compared to the 2017 national elections.
The AfD — which saw a marked success in the 2017 elections following the influx of refugees into Germany in 2015 — has struggled to keep its momentum going since and has faced harsh criticism over ties to the extreme far-right.
The closeness of the race coupled with Germany’s complicated voting system means it could take some time before a winning coalition is formed and the ultimate victor is known.
Environmental concerns and economic worries have emerged as key issues in campaigning, with the former fueled by the deadly floods that devastated parts of Germany this summer.

The man was at a tailgating event at a Fairfield High Preparatory School parking lot when he was shot in the buttocks — with the gunfire apparently coming from near an abandoned house — around 9:45 p.m., the Jefferson County Sheriff’s Office said.
The gunfire halted the football game between Fairfield High and Birmingham’s Jackson-Olin High. A sheriff’s deputy got onto the field and waved for people — including players and coaches — to get onto the ground, video from WBMA shows.
“Stay calm. Stay down,” an announcer says over the public address system, as players were prone on the field and sidelines. Some spectators ran while others sat or crouched in the stands amid shouts of fright and concern.
The players eventually were directed to get up and leave the field.
Deputies searched the area but did not immediately find the shooter, the sheriff’s office said.
The gunshot victim was taken to a hospital with a non-life-threatening wound, according to the sheriff’s office.
Fairfield is just outside Birmingham.
The remainder of the game was postponed until Saturday, the sheriff’s office said.
